Terms of Service

1. Who we are
BenWorkSpace is a digital-services studio operating from Malaysia. Business registration with SSM (Companies Commission of Malaysia) is in progress; this page will carry the registration number once issued. Contact: echothisisabc@gmail.com.
2. What this site is
This website is informational. Descriptions of services and process here are an invitation to enquire, not a binding offer. Every project runs under its own written agreement (a one-page Statement of Work) that states the exact scope, price, and terms — where that agreement differs from this page, the agreement wins.
3. How engagements work
You email us what you need; we reply with a written scope, a fixed price, and the agreement. Paying the deposit constitutes acceptance of that scope and agreement. After the deposit, you receive a detailed project spec, which we refine with you before building. Work not listed in the agreed scope needs a written change order — additions are a conversation, never a surprise invoice.
4. How the work is produced (AI disclosure)
Our services are AI-assisted and human-reviewed: we use AI tools and automated systems, under human oversight, to produce and communicate work, and a person reviews every deliverable before it reaches you. AI-assisted output can contain errors; that is what the revision rounds and acceptance window in your agreement are for.
5. Payment
Fixed prices, stated up front. Typical schedule: a deposit to begin and the balance on delivery, paid through a secure payment link. Work may pause if an invoice remains unpaid past the period stated in your agreement. See also our refund policy.
6. Timelines
Timeline targets are good-faith estimates, not guaranteed service levels, and depend on you supplying the inputs and approvals your agreement lists. We do not offer uptime or response-time SLAs unless an agreement explicitly says otherwise.
7. Intellectual property
On full payment, rights to the final delivered work are assigned to you — except our pre-existing tools, libraries, and general know-how, which remain ours and are licensed to you as needed to use the deliverables. We may reference the engagement as a portfolio item unless you opt out in writing.
8. Liability
Work is provided on a best-effort, as-is basis. Our total liability for any engagement is limited to the fees you actually paid for the affected deliverable; we are not liable for indirect or consequential damages such as lost profit, data, or business.
9. Governing law
These terms and our agreements are governed by the laws of Malaysia.
10. Changes
We may update this page as the business evolves; the "last updated" date above changes when we do. Signed agreements are unaffected by later changes to this page.
